Terms of Sale/User Agreement

Thank you for shopping with Kane McIntosh (known as ‘me’, ‘my’, ‘us’, ‘we’, or ‘our’). By placing an order on kanemcintosh.com, galleries.kanemcintosh.com, store.kanemcintosh.com, kanemcintosh.mypixieset.com, or kanemcintosh.pixieset.com (known as ‘my sites’), you agree to the terms of sale outlined below. The purchase of digital images, prints, or any other products through my sites provides you with a license for personal use only. If you wish to use my work in a commercial nature, please get in contact with me to arrange a licensing deal. You are only permitted to make copies of images, or reproduce images in a physical format if you have explicit permission to do so. If you have purchased a print release or your session includes a print release, you are permitted to reproduce images or make physical prints for personal use only.

Refunds and exchanges

Products sold by me through my sites are non-refundable. Products that arrive damaged due to shipping and handling will be replaced at my discretion, within a 10 day period of receiving your order. Conditions for returns are as follows:

All goods returned must be complete; no items missing.
Returns will not be accepted on goods that have been intentionally mistreated or damaged.
Associated fees and charges (shipping, handling, etc) are non refundable under all circumstances.
Returned goods must be shipped prepaid; I will not be liable for return shipping expenses.
If goods are missing, damaged, or do not match description, they must be reported within 14 days of your item being shipped.
Please allow 14-21 days for replacement orders to be fulfilled and shipped.
For unauthorised returns/invalid address returns, a fee of 20% will be charged, plus any related shipping and handling fees

Trademarks and copyright

All images, text, and other content appearing on my sites are the property of Kane McIntosh. This is includes my images, text, descriptions, logos, graphics, and other design elements on my sites. The content on my site is to be used for the sole purpose of interacting with, making purchases, or sharing on social media channels or by other means for the purpose of promotion. In the case of sharing or promotion, credit must be given to Kane McIntosh and content on my sites may not be used for commercial purposes without prior written permission. The unauthorised use of content on my sites may violate various trademark and copyright laws, and could result in fines, and civi or criminal penalties. Examples of unauthorised use includes, but is not limited to, republishing, uploading, modifying, copying, distributing or transmitting any material on my sites without prior written permission from Kane McIntosh. The Kane McIntosh name, KM logo, and my sites are all properties of Kane McIntosh.

Limitation of Liability & Disclaimer

Unless otherwise stated, because of illegal reproduction services and the custom nature of the transaction, products sold on my sites are not refundable. Items deemed to be missing during transit, damaged, or not matching description will be replaced or refunded at the sole discretion of Kane McIntosh. Kane McIntosh expressly disclaims any and all warranties related to goods sold, express or implied, including but not limited to, fitness for a certain purpose or merchantability. You agree that the sole and exclusive liability to Kane McIntosh for any product sold on my sites shall be the price of the product ordered. Under no circumstances shall Kane McIntosh, its officers, employees, or other representatives, be liable for special, indirect, consequential, or punitive damages related to products sold. You agree that Kane McIntosh, its officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of my sites.

Typographical & Photographical Errors

Kane McIntosh attempts to be as accurate as possible in my pricing, as well as my typographical and photographical depictions of products for sale; however, I cannot guarantee that product descriptions/specifications, pricing or any other content on my sites is accurate, complete, or current. In the event that a product is listed at an incorrect price due to typographical, informational, technical or other error, Kane McIntosh shall have the right, at my sole discretion, to either honour the displayed price or refuse/cancel any orders placed for that product at the incorrect price.

Order Acceptance Policy

Your submission of an order and/or receipt of an order confirmation, automated or otherwise, does not signify my acceptance of such order. Kane McIntosh reserves the right to cancel any order that I deem necessary, at my sole discretion, regardless of the order status or whether you have received a confirmation of the order. I reserve the right to require additional information from you before accepting or processing any order.

Sales Policy

By placing an order on my sites, you agree to the terms of sale as outlined on this site. By placing an order on my sites, you agree to the total value of the sale, including shipping and taxes where applicable, and authorise Kane McIntosh to collect payment via the payment method the customer has selected. I reserve the right to make changes to this site, and these terms and conditions, at any time.

I attempt to be as accurate as possible in my pricing, content, and descriptions. However, in the event that a product is listed at an inaccurate price for any reason, I shall have the right to refuse or cancel any orders placed at the incorrect price.

Your Personal Information

Kane McIntosh does not rent, trade, loan, or sell your personal information, or any other information which may identify you, to third parties. I am committed to protecting my customers’ privacy. The information I collect is used to process your order and to enhance your shopping experience.

When you place an order at my sites, you provide me with your name, email address, credit card information, address, and phone number. I use this information to process your order. The financial information (credit card number, expiration date, billing address, etc.) that I collect from you is used for billing purposes only.

I also work with third parties that perform various vital functions on our behalf. Such functions include shipping and delivering of packages, fulfilling orders, etc. These third parties will have access to personal information as required for them to carry out these functions on my behalf. They are also under strict obligation to keep your personal information private.

Your Consent

By using my sites, you agree to let me collect the aforementioned information, and use it in said manner. Any changes to the terms of sale/user agreement will be posted on this page. Kane McIntosh will cooperate with law enforcement agencies to identify any individual who attempts to use our service for unauthorised or illegal activities. I also reserve the right to report any unlawful or suspicious activity to the appropriate authorities. Additionally, I may release necessary information to enforce my terms of sale/user agreement, or to protect the rights, property, and safety of our users. Other sites accessible through my sites have their own privacy policies and data collection agreements. I am not responsible for the actions of third parties.

Voucher Policy

Any and all vouchers purchased through my site or other sources are non-refundable, and cannot be exchanged for cash. They have a set expiration date, after which point they will not be eligible for use and cannot be reactivated or exchanged for cash.

All images and content are property of Kane McIntosh, and protected by copyright law. Content on my sites cannot be used, copied, or published for commercial use with written permission from Kane McIntosh. I reserve the right to use all images from your session on my site, blogs, social media, or any other related marketing material.
